TOWN of POWERVIEW – PINE FALLS
BY-LAW 32/08
Being a by-law of the Town of Powerview-Pine Falls to provide for the 2008 Annual Tax Levy
WHEREAS Section 304(1) of The Municipal Act, L.M. 199, c.58 requires as follows:
304(1) No later than May 15 of each year, after adopting its operating budget for the year, a council
must by by-law
a) set a rate or rates of tax sufficient to raise
(i) revenue to be raised by property taxes as set out in the operating budget, and
(ii) the revenue to be raised in the year to pay for local improvement or special service and to pay the
requisitions payable by the municipality;
b) impose taxes
(iii) in accordance with the tax rate or rates set under clause (a) on the portioned value of each
assessable property in the municipality that is liable under The Municipal Assessment Act to that tax,
and
(iv) where the tax is in respect of a local improvement or special service, in accordance with the local
improvement or special services by-law; and
c) set a due date for payment of taxes.”
AND WHEREAS the Town of Powerview - Pine Falls has made estimates of all sums required for
lawful purposes of the Corporation for the year 2008;
AND WHEREAS it is necessary by by-law or by-laws to levy a rate or rates of so much on the dollar
upon the assessed value of all rateable property liable therefore in the Municipality as the Council deems
sufficient to raise sums required for the lawful purpose of the corporation as shown by the said
estimates;
AND WHEREAS the assessed value of the whole rateable property within the Town of Powerview -
Pine Falls according to the last revised assessment roll and the Pine Falls Record of Property Values is
Forty-one Million, Eight Hundred and Eighty Thousand, Four Hundred and Ninety Dollars ($
41,880,490.)
AND WHEREAS it is deemed necessary to fix the rates of taxation for the purposes aforesaid and the
time for the payment of all rates and taxes so fixed and levied;
NOW THEREFORE the Mayor and Council of the Town of Powerview - Pine Falls in council duly
assembled hereby enact the following:
1. THAT the estimates of the Town of Powerview - Pine Falls of all sums required for the lawful
purposes of the Corporation for the year 2008 as set forth in schedule “A” attached hereto and
identified by the signatures of the head of Council, Chairman of Finance and the Chief Administrative
Officer are hereby approved.
2. THAT the following respective rates of so much per one thousand dollars of assessment be and are
hereby levied for the year 2008 upon the assessed value of all rateable property in the municipality
respectively liable therefore according to the last revised property assessment roll of assessable
property of the corporation, which said rates, assessed values and sums required are set out in
Schedule “A”;
a) A mill rate of 16.08 on all Other assessed property in Ward 1 and Ward 2 – to raise the required
amount for the Sunrise School Division, plus an allowance for tax asset.
b) A mill rate of 24.17 on all rateable property in Ward 1 and Ward 2 - to raise the required amount for
the Sunrise School Division, plus an allowance for tax asset.
c) A mill rate of 0.28 be assessed on all rateable property in Ward 1 to raise the required amount to
meet the Town of Powerview - Pine Falls Paving LID #2/2005 as per By-Law No. 17/06, plus an
allowance for tax asset.
d) A mill rate of 4.62 be assessed on all rateable property in Ward 2 – to raise the required amount to
meet the Town of Powerview-Pine Falls Storm Sewer LID #1/2005 as per By-law 26/07, plus an
allowance for tax asset.
e) A mill rate of 0.24 on all rateable property in Ward 1 and 2 – to raise the required amount of ten
thousand dollars ($10,000.00) to be deposited to the General Reserve, plus an allowance for tax asset.
f) A mill rate of .55 on all rateable property in Ward 1 and 2 – to raise the required amount of Twenty-
two Thousand Nine Hundred and Fourteen Dollars ($22,914.00) to be deposited to the Public Works
Shop Reserve, plus an allowance for tax asset.
g) A mill rate of 22.39 be on the dollar, made up of the rate or rates be and is hereby levied for the year
2008 upon the assessed value of all rateable property in the municipality liable therefore according to
the last revised Assessment Rolls and Table of Property Values, as the case may be, of general and
personal property thereof, to provide controllable purposes of the corporation, viz:
General Government Services, Protective Services, Transportation Services,
Environmental Health Services, Public Health and Welfare Services,
Environmental Development Services, Economic Development Services,
Recreation and Cultural Services, Fiscal Services.
and for an Allowance for Tax Assets as set out in Schedule”A”.
3. THAT all taxes and rates imposed and levied in the Town of Powerview - Pine Falls for the year
2008 shall be deemed to have been imposed and to be due and payable on the 31st day of October 2008.
4. THAT all taxes and rates imposed and unpaid for the year 2008 following the date set for payment
shall be subject to a penalty of Fifteen (15) per cent per year, or one and one-quarter (1 ¼ ) per cent
per month.
5. THAT the estimated expenditures set forth in Schedule “A”, pages 7 and estimated revenue set forth
in Schedule “A”, pages 7 and the same are hereby approved for purpose of operating the Water and
Sewer Utilities.

Town of Powerview - Pine Falls, in the Province of Manitoba, this th day of A.D.
